BENDEMEER harness racing trainer Robert Clement has been fined $3000 and had his trainer’s licence suspended following an inquiry into his running of the wrong horse at a meeting at Narrabri on March 9.
Harness Racing NSW this week concluded its inquiry into the presentation of Banyula Fella instead of Final Count in race two of the Saturday meeting.
Banyula Fella, which was due to run in race five, won the race but it was later found the horse’s brands did not match those of Final Count.
In his evidence to the inquiry Mr Clement admitted he had mistakenly presented the wrong horse.
He said Banyula Fella had recently entered his stable and was having his first start for him, and that he had arrived late at the track and become distracted during the preparation of Final Count, subsequently gearing up the wrong horse.
The official in charge of the horses’ identification before they enter the track told the inquiry that due to an infestation of burrs around the Narrabri parade ring, which would have affected the sulky tyres, the runners were not required to parade prior to the race, instead going from the stables straight to the track.
Vince Brennan said the runners had progressed simultaneously onto the track and while he had identified other horses, he failed to identify Final Count.
The inquiry concluded it was an accidental breach by Mr Clement, who pleaded guilty to a charge of “a person shall ensure the correct horse is presented to start in a race”.
It accepted both horses raced in similar gear, both were bay in colour, runners did not parade as per requirements and the identification official failed to properly identify Final Count.
As Mr Clement had been issued with a sixmonth conditional trainer/driver licence by the HRNSW board on October 23 last year, stewards suspended his licence until a report is considered by the board. HRNSW will also conduct a review of all horseidentifying procedures currently used by raceclubs.
Ohio State Racing Commission officials said June 11 an investigation into the circumstances behind a race in which the wrong horse competed and finished last as the favorite at River Downs near Cincinnati revealed it was a mistake with no fraudulent intent.
On May 30 in the 13th race, a $5,000 claiming event for fillies and mares, 3-year-olds and up that hadn't won two races lifetime, Sing High Sing Low was listed as number 12 in the program, but it was actually the maiden Mountain Of Light that competed and finished last as the slight betting favorite.
Both 3-year-old fillies were listed as being owned by Billy Hays and trained by Joe Woodard. The Daily Racing Form chart for May 30 reads: "Mountain of Light, racing misidentified as Sing High Sing Low, dueled for the lead from the outside, was used up and stopped in the stretch."
The chart also said Sing High Sing Low (Peaks and Valleys--Songs of Praise, by Palace Music) was "scratched." Mountain of Light (Jules--Solar Annie, by Sejm) was entered in a $5,000 maiden-claiming race the next day at River Downs, and was subsequently scratched.
Luther Heckman, chairman of the racing commission, said June 11 he had spoken with Clifford Nelson, the commission's executive director, about the incident.
"It seems to me Clifford had come to the conclusion that it was an honest error, but there had to be fines," Heckman said. "It was not a fraudulent problem."
Nelson could not be reached immediately for comment, but Steve Zaper, an investigator with the racing commission, said Woodard was fined $500 for leading the wrong horse to the paddock, and was fined another $250 for bringing the wrong horse over on another day at River Downs. (That horse was scratched and didn't race.) Patricia Mularkey, the horse identifier at River Downs, was fined $250.
Woodard was the third-leading trainer at the meet through June 10 with 11 wins. He had the most starts of any trainer with 59.
All parties had 48 hours to appeal, but no appeals were filed. Heckman said because of that, the matter wouldn't come before the full commission.
The commission by policy doesn't reveal details of investigations, but Zaper said: "We look into all other possible angles on something like this."
In the May 30 race, Mountain of Light, racing as Sing High Sing Low, was the 5-2 favorite. The total win, place, and show pool was $37,017. The winner was Kobemon at 5-1, followed by Strawberry Turn in second at 29-1, and Subtle Style, the co-favorite at 5-2, third. The $2 exacta paid $261.40, the $2 trifecta paid $2,350.60, and the $2 superfecta paid $8,371.40.
A claim was lodged for Sing High Sing Low, but the trainer who claimed her discovered he had the wrong horse a few days later, according to individuals who frequent the River Downs barn area. Zaper said the claim was voided.
Meanwhile, Sing High Sing Low was entered again June 10 at River Downs. She finished second in a $5,000 claiming event for non-winners of two races lifetime and was claimed, but not by the same trainer.
Trainer Jamie Ness has been fined $1,000 by the stewards at Presque Isle Downs in Erie, Pa., for entering the wrong horse in a maiden special weight race on July 13, in a case of mistaken identity that could lead to further sanctions in both Pennsylvania and Delaware, where the mix-up was discovered.
Ness entered an unraced 2-year-old named Rome Is Freezing in the Presque Isle Downs race, but the horse he shipped to Presque Isle Downs from Delaware Park was actually an unraced 2-year-old named Rapid Rampage, according to Ness and racing officials. The horse identifier at Presque Isle, Johnny Perez, failed to determine that the horse in the paddock was not the horse that was entered, and the horse went on to finish fourth in the five-horse field, earning $1,250.
Both horses are bay, and though records show that Rome Is Freezing is a gelding and Rapid Rampage is a colt, both horses have been castrated, according to Ness.
Ness said that the two horses were among a batch of 10 2-year-olds he received from Florida earlier this summer. He said that the two may have been placed in each other’s stalls because of their physical similarities. He said the switch was entirely accidental and that he accepted his fine.
“I’m responsible for bringing the wrong horse to the paddock,” Ness said. “After that, it’s unfortunate the horse identifier did not catch it.”
Ness did not travel with the horse. He said his assistant who went to Presque Isle with the horse told him that the identifier at Presque Isle had flipped the horse’s lip in the paddock but did not notice that the lip tattoo was for the wrong horse.
Perez has been suspended by Presque Isle Downs and is facing sanctions from both the track and the Pennsylvania Thoroughbred Racing Commission, according to the commission’s executive secretary, Daniel Tufano.
“I don’t think anyone’s denying the circumstances of what happened,” Tufano said. “You would like to think that there are procedures in place to prevent such an occurrence.”
The mix-up was caught by state veterinarians at Delaware Park on Tuesday after Ness entered Rapid Rampage in a maiden special weight race. The veterinarians discovered then that the horse was actually Rome Is Freezing, leading them back to the July 13 race at Presque Isle Downs. The horse was not allowed to start.
John Wayne, executive director of the Delaware Thoroughbred Racing Commission, said that Ness will need to appear before the Delaware Park stewards to face possible sanctions relating to the mix-up.
“Not to be investigator, judge, and jury at this point in the inquiry, but I’ve already told Mr. Ness that this is a mistake that should not happen,” Wayne said.
One week after the wrong horse started, Ness said that he was relieved that the horse finished fourth in a race without superfecta wagering, since payoffs to bettors were not affected. “It’s the first time in my life I’m glad a horse didn’t run good,” Ness said.

Muhtiman,I havent personally worked with grooms but I have been to stables where the loading preparation is a finely tuned operation.In this case it was not a case of a groom or stable manager having to load a float of horses.They had to take THREE horses to the course.I might speak under correction but if I am not mistaken both the horses in question come from Mr Adams's stud farm.

Muhtiman,I havent personally worked with grooms but I have been to stables where the loading preparation is a finely tuned operation.In this case it was not a case of a groom or stable manager having to load a float of horses.They had to take THREE horses to the course.I might speak under correction but if I am not mistaken both the horses in question come from Mr Adams's stud farm.

?......communication communication communication......if you had followed this story through the relevant posts and write ups in SP etc.......the horses were labled at the farm incorrectly........both being chestnuts stickers were placed on them for identity purposes........but mixed up there......so l ask again how is it the trainers fault for not knowing that an error had already taken place........:S

?......communication communication communication......if you had followed this story through the relevant posts and write ups in SP etc.......the horses were labled at the farm incorrectly........both being chestnuts stickers were placed on them for identity purposes........but mixed up there......so l ask again how is it the trainers fault for not knowing that an error had already taken place........:S

Does anyone know what the appropriate NHA rule says (if there is one)?
Was the horse's microchip checked when it was passed for a starting stalls certficate, which is mandatory for all horses before they are allowed to race?

I already took some time to address the problems that may arise if every Tom Dick and Harry had access to a chip scanner......but here goes again......having a chip scanner would enable some Joe to locate the chip.....and remove it .....and replace it with some other chip......pulling off a ringer sting of note.....so it is not a question of how much they cost.....but in who's hands they would fall into.......not only be able to pull off a coup on a race course but sell a live donkey that looks like your turf champion......when you just sent your dead superstar to the lion park.....:

I already took some time to address the problems that may arise if every Tom Dick and Harry had access to a chip scanner......but here goes again......having a chip scanner would enable some Joe to locate the chip.....and remove it .....and replace it with some other chip......pulling off a ringer sting of note.....so it is not a question of how much they cost.....but in who's hands they would fall into.......not only be able to pull off a coup on a race course but sell a live donkey that looks like your turf champion......when you just sent your dead superstar to the lion park.....:

but surely any vet has a scanner for dogs and cats - try google and you'll find universal scanners on sale for a few thousand rands so I don't buy that at all - This is not some new technology at all and is available easily unless there is something special about horse chips(which i doubt)

.....yes Mr H same thing for dogs and cats etc.....but Vets are deemed to be above reproach like doctors and lawyers etc. but it still does not mean that things like these are as easily made a available to joe public as it puts temptation into play.....look at our fair land were every other dief has a remote jammer, a card scanner, cell phone blocker and the combination to a safety deposit locker ....arm some ingrates with the knowledge of chips and scanners and there are bound to be a few ringer planners.....so best we hope that we have not given some fool an idea

At least the appeal of the fine won't make front page news and embarrass racing people like the original misdemeanor did.

None of this .....your mistake made us look like dicks.... fine 10 times more....:
