As normal on ABC, we try to let things flow as much as possible and react to emails/sms/phone calls, and based on inputs I have to make a call.
Some I get wrong and some I get right, but with the nature of a Forum, people have different views and opinions and you can never keep all parties happy.

I'm punting with Betfair again, I take it the press release is a green light - at least nobody seems to know or say otherwise although Barry Irwin obviously doesn't want them anywhere near South African racing.

I'm with Spider on this.....Basic law of contract is that both parties must be legal entities,so to say Betfair is illegal in this country says the contracts are invalid!They must make up their mind!
And BTW it is NOT illegal to debate the legality and boundaries of exchanges,only to advertise them.

I've been trying to find the source the legality issues.
The NGB and NHA rules are above. Here is the one from the SARB regarding exchange controls, taken from the exchange control manual under "2.1.7 Payments by means of credit and/or debit cards".
NOTE : It is illegal for South African residents to participate in foreign lotteries, sweepstakes and betting organisations. The use of credit (or debit) cards to facilitate payment for these purposes is, therefore, irregular and a contravention of the Exchange Control Regulations. This could lead to not only the withdrawal of all credit cards of the holder but also to prosecution in terms of the aforementioned Regulations.
Honestly, trying to understand this is mind-boggling, maybe because I'm not a lawyer!
The NGB says these things are illegal in terms of foreign exchange rules. The exchange control rules say that using credit cards to participate is a contravention BECAUSE they are illegal. Which is it? Contravenes exchange controls because its illegal, or illegal because it contravenes exchange controls?
The National Gambling Act 2004 www.acts.co.za/National_Gambling_2004/index.htm is probably the place to find the answer. I would guess that it's simply a matter of a specific company, eg. Betfair, being granted a licence (by the NGB?). Maybe someone that understands 'legalese' can figure it out.

Please be aware we are now expecting to launch South African Tote pool betting within the coming week. All South African Tote pools will be available including all Win and Place pools, and all individual race and multi-leg exotic pools.
Additionally we are currently expecting to make live streaming of all South African racing available prior to the Grade 1 Champions Cup meeting at Clairwood on Saturday, 25 July.
