Cape Town - German software giant SAP has said that SA's Companies and Intellectual Property Commission has laid charges against it with police in connection to Eskom and Transnet contracts it facilitatied with assistance from Gupta-linked companies as third parties.
The charges related to SAP's alleged contravention of sections of the Companies Act of 2008, as well as sections of the Prevention and Combating of Corrupt Activities Act of 2004.
The company, in a telephonic press conference briefing, said that a recently-concluded internal SAP investigation had found irregularities in the management of these third party transactions and adherence to SAP internal processes.
Executive board member Adaire Fox-Martin told reporters that the investigation had confirmed no evidence of payments to any South African government official or employee of a state entity in connection with the Transnet and Eskom transactions.
“The central findings confirm that there were payments to Gupta-related entities, indications of misconduct relating to the management of Gupta-related third parties and irregularities in the adherence to SAP’s compliance processes,” said Fox-Martin.
Last year SAP voluntarily approached the United States Department of Justice as well as the United Securities and Exchange Commission to disclose the transactions.
We're cooperating
Fox-Martin told reporters that the company indicated to the Directorate for Priority Criminal Investigations (Hawks) that it would cooperate with any action which the Hawks take in connection with the matter, and that it would continue to engage with US authorities.
The company has not heard from the Hawks since proactively notifying them of their cooperation, she said.
“The actions of the US authorities could take years. We receive monthly updates from them on the process and they are starting to ask for documents and they have indicated that they would like to speak to people involved and there seem to be some delays,” Fox-Martin said.

After 9 months of intensive investigations, SAP have not charged Brett Parker. There are no charges at ALL ! You idiot.
Perhaps, Flowers, you should send your MOTHER, instead, as a groom. And please feel free to come out of the closet. As for Brett Parker- All that I can do, Flowers, is give u the facts. The intellect to grasp those facts is not in my power to give you.....not even Harry Potter would be able to help u on that score. The Creator failed in that dept, at your birth.
Of all of those names that you mention, Brett is my good mate and an Owner in my yard.
But, keep up the good work of hiding in your closet, an absolute nobody, as you point fingers at all and sundry. And ABC will continue to entertain your disease, as ABC is not as much about Racing, as it is about "hits".... ABC needs you more than you can imagine....

I would hazard a guess reading this that SAP are the guilty party here and not Brett Parker - SAP have continually denied knowledge of Gupta business being done and this trashes that lie. As I see it, Parker or SAP South African management got approval from the "global compliance team" whoever or whatever they are, but sounds pretty damning to me.
